Brazil regulates procedure for energy projects eligible to tax incentives


Brazil’s Ministry of Mines and Energy issued Ordinance 263/07, which establishes the procedures for approval of energy generation and transmission projects eligible to tax incentives under the Special Incentive Regime for Infrastructure Development (REIDI). REIDI grants tax incentives for infrastructure projects involving transportation, ports, energy, and sanitation such as suspension of certain taxes on local purchases and imports of new machinery, instruments, equipment, and construction materials. Ordinance 263 delegates powers to the National Agency of Electric Energy (Agência Nacional de Energia Elétrica, or ANEEL) to review applications for REIDI in the energy sector.
