Brazilian court decides that electronic mail is not valid as evidence


The ninth panel of the Superior Labor Court of Campinas upholded a court decision concerning the illegitimacy of an overtime request on a labor claim. The employee used, as a support document, to corroborate with his plead of overtime journey, e-mails sent and received after his working hours. The judge stated that the time indicated on the message is not able to prove that the employee was working at such time, and added to his decision that the employee may be connected to the internet even from other computers or in his own house.
