Even with the CFC regime’s constitutionality currently under review by the Supreme Court, Superior Court of Justice (Superior Tribunal de Justiça, or STJ) ruled that Brazil’s controlled foreign corporation regime is legal. The decision did not accept the taxation for foreign affiliate companies. The decision was published in Brazil’s official gazette of November 13.
