Court awards indemnification for use of illegal copy of software


The 4th chamber of Brazil’s Superior Court of Justice decided that a Brazilian company must pay an indemnification of five times the market value of a software program to the software’s owner for use of a pirated version of such software. During trial, the court rejected the defendant’s allegation that the awarded amount was unreasonable and would impair the defendant’s business activities (Special appeal No. 740780).
