Lack of Supervision Results in Environmental Liability to the Administration


In an unprecedented decision, Brazil’s Superior Court of Justice (Superior Tribunal de Justiça, or STJ) decided that the federal Administration is jointly liable with private companies for damages caused to the environment. The court ruled that the Administration’s omission to supervise and control the companies’ activities should result in joint liability for environmental damages. (Special Appeal No. 647,493)
