No tax crime exists before tax assessment is definite, Supre Court Rules


In deciding a habeas corpus, Brazil’s Supreme Court ruled that no tax crime exists before the tax assessment is considered definite. The decision rejected a tax crime case based on the fact that at the time that criminal charges were filed the civil tax case at the administrative level was still pending definite decision.
