Permanent protected area not subject to indemnification, superior Court Rules


Brazil’s Superior Court of Justice ruled that forest coverage of permanent protected area located in a rural property is not subject to indemnification by the government in case of expropriation. The Court took the position that indemnification is not applicable because the protected area cannot be economically exploited due to environmental restrictions. (Special Appeal 935,888)
